License Agreement

You should carefully read the following terms and conditions before using this software.  Unless you have a different license agreement signed by Neomesh Microsystems, your use of this software indicates your acceptance of this license agreement and warranty.

Use of Neomesh WinGraphic (hereinafter 'SOFTWARE') is contingent on your agreement to the following terms:


GRANT OF LICENSE
Neomesh Microsystems (hereinafter Neomesh Microsystems) grants you a limited non-exclusive license to use the SOFTWARE for twenty one (21) days for the  purpose of evaluating whether to purchase a commercial license. After 21 days you should register or quit using it.
If you are using the SOFTWARE free of charge under the terms of this Agreement, you are not entitled to any support whatsoever.

DISCLAIMER OF WARRANTY
THE SOFTWARE IS PROVIDED AS IS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEOMESH MICROSYSTEMS FURTHER DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND ONINFRINGEMENT.
THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF THE PRODUCT AND DOCUMENTATION REMAINS WITH RECIPIENT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NEOMESH MICROSYSTEMS BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, DIRECT, INDIRECT, SPECIAL, PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THIS AGREEMENT OR THE USE OF OR INABILITY TO USE THE PRODUCT, EVEN IF NEOMESH MICROSYSTEMS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED.
THE USER MUST HAVE NO OBJECTIONS ABOUT SENDING ELECTRONICALLY ANY INFORMATION THAT IDENTIFIES HIMSELF AND THE COMPUTER RUNNING THE SOFTWARE, USING NEOMESH WINGRAPHIC.

Good data processing procedure dictates that any program be thoroughly tested with non-critical data before relying on it.
The user must assume the entire risk of using the program.  ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE.

SCOPE OF GRANT
You may not reverse engineer, decompile or disassemble the SOFTWARE. Neomesh Microsystems shall retain title and all ownership rights to the SOFTWARE.

COPYRIGHT
This SOFTWARE is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.

MAINTENANCE
Neomesh Microsystems is not obligated to provide maintenance or updates for the SOFTWARE. However, any maintenance or updates provided by Neomesh Microsystems shall be covered by this Agreement.

Registered Version

One registered copy of Neomesh WinGraphic may either be used by a single person who uses the software personally on one or more computers, or installed on a single workstation used nonsimultaneously by multiple people, but not both.

You may access the registered version of Neomesh WinGraphic through a network, provided that you have obtained individual licenses for the software covering all workstations that will access the software through the network.  For instance, if 4 different workstations will access Neomesh WinGraphic on the network, each workstation must have its own Neomesh WinGraphic license, regardless of whether they use Neomesh WinGraphic at different times or concurrently.


Evaluation Version

Evaluation and Registration

This is not free software.  Subject to the terms below, you are hereby licensed to use this software for evaluation purposes without charge. The evaluation software has two limitations: it displays a unregistered popup at times and after 21 days of first run it will not be able to save files. If you want a full-featured version, a registration fee is required (select Registration from the Neomesh WinGraphic Edit menu). When payment is received, you will be sent a registration code that will unlock the disabled features of the latest version of Neomesh WinGraphic.

Distribution

Provided that you verify that you are distributing the UNREGISTERED version you are hereby licensed to make as many copies of the evaluation version of this software and documentation as you wish; give exact copies of the original evaluation version to anyone; and distribute the evaluation version of the software and documentation in its unmodified form via electronic means.  There is no charge for any of the above.

You are specifically prohibited from charging, or requesting donations, for any such copies, however made; and from distributing the software and/or documentation with other products (commercial or otherwise) without prior written permission (to get permission contact us via email at neomeshsupport@neomesh.com).

The registered software cannot be redistributed.  The registration information (Registration Code) is confidential and cannot be distributed.

Definitions.
"License" shall mean the terms and conditions for use, reproduction, and distribution as defined by Sections 1 through 9 of this document.

"Legal Entity" shall mean the union of the acting entity and all other entities that control, are controlled by, or are under common control with that entity.
